Abandoning individual enforcement? Interrogating the enforcement of age discrimination law

Abstract Discrimination law primarily relies on individual enforcement for addressing discrimination at work; yet those who are most impacted by likely the least able to enforce their rights. The question then becomes: what role should play in law? Can we effectively abandon as part of legislative model? Drawing a mixed method, multi-year comparative study age UK, Australia and Sweden, this paper considers gaps, limits risks model law. Integrating doctrinal analysis; statistical analysis claims cases, data from EU OECD; qualitative expert interviews; survey legal practitioners, argues that while is inherently limited tool achieving systemic change, it must remain any model. Reflecting experience where significantly curtailed, posits rights important complements other regulatory tools, particularly jurisdictions with strong enduring norms.
